The IT Act provides various incentives to the corporate sector. Some of them have been discussed as under:

·      Generation /generation and distribution of power;

·      Undertaking substantial renovation of existing transmission and distribution lines;

·      Laying down and operating cross country natural gas distribution network;

100% of the profits for 10 years out of a block of 15 years.

Developing or operating any infrastructure facility

100% of the profits for 10 years out of a block of 20 years

Commercial production or refining of mineral oil

100% of profits for 7 years

An undertaking engaged in manufacture or production of any article or thing, situated in the states of

·         Sikkim;
·         Any of the North Eastern states;
 
·         Himachal Pradesh or

·        Uttaranchal

·        100% of the profits in the state of Sikkim or in any of the North Eastern States 10 years.

·        In the state of Himachal Pradesh or Uttaranchal:

§   100% of profits for initial   5 years;

§   25% (or 30% in case of a company) of the profits in the next 5 years.

Business of hotels and convention centers situated in the National Capital Territory of Delhi, Faridabad, Gurgaon, Gautam Budh Nagar and Ghaziabad

100% of the profits for initial 5 years.

Certain eligible businesses carried on in the North-Eastern States

100% of the profits for a period of 10 years

Company engaged in the business of drugs, computers etc. incurring expenditure on in house research and development facility

1 ½ times of the expenditure incurred

Corporate re-organizations, such as mergers, demergers and slump sales are either tax neutral or concessionally taxed subject to fulfillment of prescribed conditions.

The above deductions are available subject to fulfillment of various conditions as laid under the respective provisions of the IT Act.

Concessions for specific sectors

Under the IT Act, concessions have been given for certain specific sectors. These have been briefly described below:

·         A deduction of 100% of the profits for 10 years out of a block of 15 years is allowed subject to fulfillment of certain conditions in the following sectors:

§         telecommunication services,

§         development of industrial parks and SEZ,

§         generation/generation and distribution of power

§         undertaking substantial renovation of existing transmission and distribution lines,

§         laying down and operating cross country natural gas distribution network

·       In case of developing or operating any infrastructure facility a deduction of 100% of the profits and gains is allowed for 10 years out of a block of 20 years subject to fulfillment of certain conditions.

·     In case of business of commercial production or refining of mineral oil deduction of 100% of profits is allowed for 7 years subject to fulfillment of certain conditions.

 

In case of business of hotels and convention centers situated in the National Capital Territory of Delhi, Faridabad, Gurgaon, Gautam Budh Nagar and Ghaziabad 100% of the profits are allowed as deduction for initial 5 years.
